Official Rules

 

THESE OFFICIAL RULES ARE A CONTRACT—READ THEM CAREFULLY BEFORE ENTERING. WITHOUT LIMITATION, THIS CONTRACT INCLUDES A RELEASE AND LICENSE FROM YOU, AND A LIMITATION OF CERTAIN OF YOUR RIGHTS AND REMEDIES.

 

NO PURCHASE NECESSARY. PURCHASES DO NOT INCREASE ODDS OF WINNING. THE FOLLOWING PROMOTION IS OPEN TO LEGAL RESIDENTS OF GEORGIA WHO LIVE IN AN ELIGIBLE ZIP CODE (SEE APPENDIX FOR ELIGIBLE ZIP CODES), WHO HAVE A VALID DRIVER’S LICENSE, AND WHO MEET THE ELIGIBILITY REQUIREMENTS (AS DEFINED BY THE RULES BELOW). THE PROMOTION IS VOID OUTSIDE OF THE ELIGIBLE ZIP CODES IN GEORGIA AND WHERE PROHIBITED BY LAW.

 

1. Promotion, Sponsor and Administrator: Participation in the 2025 Akins Ford Athens Rock Lobsters - FordEvents.Live Sweepstakes (the "Promotion") constitutes Entrant's (as defined below) full and unconditional agreement to these Official Rules. Entrant is free to disclaim any prize and status as Entrant, and as a result will not be eligible to receive any prize. The Promotion is sponsored and administered by Music Audience Exchange, Inc., 2595 N. Dallas Pkwy. #440, Frisco, TX 75034 ("Sponsor,” “Administrator,” or both). The Promotion is commissioned by Akins Ford LLC. Sponsor will have the exclusive authority to interpret these Official Rules and all decisions related to, as well as all interpretation of, these Official Rules by Sponsor are final and binding. While this Promotion may be promoted via social media websites, such websites are not affiliated with Sponsor or this Promotion. This Promotion is in no way sponsored, endorsed or administered by, or associated with any other site or medium that might host content where information about this Promotion is posted or published (collectively "Content Hosts"). Entrant is providing information only to Sponsor and not to Content Hosts.

 

2. Promotion Period: The Promotion begins at 12:00 AM ET on October 2, 2025 and ends at 11:59:59 PM ET on March 22, 2026 (the "Promotion Period"). Only entries submitted and received during the Promotion Period will be accepted. Sponsor is the official timekeeper of this promotion.

 

3. Eligibility: The Promotion is open only to legal residents of GEORGIA who live in an Eligible ZIP Code (see Appendix for list of eligible ZIP Codes) and are at least eighteen (18) years old or older and have a valid driver’s license at the time of entry (each an “Entrant’). Employees of Sponsor, Akins Ford LLC and all affiliates and associates of Akins Ford LLC, Ford Motor Company (“Ford”), Ford Credit, GTB Agency (“GTB”) as well as any other marketing/communications agency or media companies assisting with implementation and execution of the Promotion, the Athens Rock Lobsters, The Classic Center Authority (“CCA”) the other Federal Prospects Hockey League entities (“FHPL”), and their respective parent companies, subsidiaries, sponsor marketing employees, and affiliates, and companies involved in the implementation and execution of the Promotion (collectively the “Promotion Entities”), or their parent and affiliate companies and suppliers, as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee are not eligible. “FHPL Entities” means the Office of the Commissioner of Federal Prospects Hockey League, its Bureaus, Committees, Subcommittees and Councils, the FHPL teams, each of their parent, subsidiary, affiliated, and related entities, any entity which, now or in the future, controls, is controlled by, or is under common control with the teams or Office of the Commissioner, and the owners, general and limited partners, shareholders, directors, officers, employees, and agents of the foregoing entities. Legal entities are not eligible to enter. Eligibility is contingent upon agreement to, compliance with, and fulfillment of all requirements of these Official Rules. Participation in the Promotion in any way, including submission of any entry or the partial completion of any act of entry or any other steps taken to participate in the Promotion in any manner, constitutes full and unconditional agreement with all provisions of these Official Rules. The Promotion is void outside of Georgia and where prohibited by law.

 

4. How to Enter: NO PURCHASE NECESSARY. PURCHASES DO NOT INCREASE ODDS OF WINNING.

There are two (2) methods of entry. By participating in the Promotion in any way you will become an "Entrant." Each Entrant who enters using one of the below methods of entry will receive the specified number of entries as defined below in the Promotion.

1st Method of Entry: During the Promotion Period, you will automatically become an Entrant and receive one (1) entry in the Promotion by submitting your Information (defined below in Section 5 – “Conditions of Entry”) using the form available by scanning a direct link QR Code at the Akins Ford Arena in Athens, GA.

 

During the Promotion Period, an Entrant may receive a link to the Website by scanning the QR Code on select Promotion print materials. An Entrant may center the QR Code in the camera of his/her mobile device to scan the QR Code. Once completed Entrant will receive a link to the Website and follow the steps above to enter. An Entrant cannot participate solely by scanning the QR Code.

2nd Method of Entry: During the Promotion Period, you will automatically become an Entrant and receive one (1) entry in the Promotion by mailing a handwritten, stamped 3x5" postcard to Music Audience Exchange, Attn: 2025 Akins Ford Athens Rock Lobsters - FordEvents.Live Sweepstakes, 2595 N. Dallas Pkwy. #440, Frisco, TX 75034 ("Promotion Address"). To be eligible, the postcard must contain your first and last name, month and year of birth, email address, complete mailing address (including city, state or province, and zip or postal code), and phone number (including area code) (each eligible 3x5" postcard, a "Mail-In Entry"). Postcards must be handwritten, and no copies or reproductions will be accepted. Entrants may submit only 1 Mail-In Entry; each Mail-In Entry is one (1) entry in the Promotion. Each Mail-In Entry must be postmarked by March 22, 2026 and received at the Promotion Address by March 27, 2026 to be eligible. Each Mail-In Entry will be entered in the Promotion as of the date it is received at the Promotion Address.

Limit on Entries: Regardless of method of entry, there is a limit of one (1) entry per person, per email address during the Promotion Period.

Bonus Entries: There are four (4) ways to earn bonus entries:

1st Method of Bonus Entry: During the Promotion Period, an eligible Entrant may visit Akins Ford Dealership and locate the QR Code located on select Promotion materials. An Entrant may center the QR Code in the camera of his/her mobile device to scan the QR Code. Once completed Entrant will receive a link to the Website and follow the steps above to enter. An Entrant cannot participate solely by scanning the QR Code. An entrant will receive three (3) bonus entries by scanning the QR Code and registering for the Promotion.

2nd Method of Bonus Entry: During the Promotion Period, an eligible Entrant may locate the QR Code located next to a Ford Bronco located inside Akins Ford Arena during events. An Entrant may center the QR Code in the camera of his/her mobile device to scan the QR Code. Once completed Entrant will receive a link to the Website and follow the steps above to enter. An Entrant cannot participate solely by scanning the QR Code. An entrant will receive three (3) bonus entries by scanning the QR Code and registering for the Promotion.

3rd Method of Bonus Entry: During the Promotion Period, an eligible Entrant may locate the QR Code located on select Promotion materials during the NASCAR Night event outside the Akins Ford Arena on January 10, 2026. An Entrant may center the QR Code in the camera of his/her mobile device to scan the QR Code. Once completed Entrant will receive a link to the Website and follow the steps above to enter. An Entrant cannot participate solely by scanning the QR Code. An entrant will receive three (3) bonus entries by scanning the QR Code and registering for the Promotion.

4th Method of Bonus Entry: During the Promotion Period, an eligible Entrant may handwrite a stamped 3x5" postcard to Music Audience Exchange, Attn: 2025 Akins Ford Athens Rock Lobsters - FordEvents.Live Sweepstakes Bonus Entry, 2595 N. Dallas Pkwy. #440, Frisco, TX 75034 ("Promotion Address"). To be eligible, the postcard must contain your first and last name, month and year of birth, email address, complete mailing address (including city, state or province, and zip or postal code), and phone number (including area code) (each eligible 3x5" postcard, a "Mail-In Bonus Entry"). Postcards must be handwritten, and no copies or reproductions will be accepted. Entrants may submit only 1 Mail-In Bonus Entry; each Mail-In Bonus Entry is worth ten (10) entries into the Promotion. Each Mail-In Bonus Entry must be postmarked by March 22, 2026 and received at the Promotion Address by March 27, 2026 to be eligible. Each Mail-In Bonus Entry will be entered in the Promotion as of the date it is received at the Promotion Address.

Limit on Bonus Entries: Regardless of method of earning bonus entries, there is a limit of ten (10) bonus entries per person during the Promotion Period.

If more entries are received than permitted—whether by using multiple email addresses, identities, or any other device or artifice—the Sponsor may, at its sole discretion, disqualify the Entrant and all associated entries. All entries must be submitted in accordance with these Official Rules to be eligible.

5. Conditions of Entry: By entering or participating in this Promotion, Entrant agrees to be bound by these Official Rules and the decisions of Sponsor and its authorized representatives, which are final and binding in all matters concerning this Promotion. Entries not legitimately submitted in accordance with these Official Rules are void. Only qualified entries received by Sponsor and during the Promotion Period are eligible for participation. Sponsor is not responsible for entries that are made but not received by Sponsor, and such entries are void. All entries become the property of Sponsor and will not be acknowledged or returned.

 

Entrant must provide all the information requested in the registration form. Entrants must fully complete and submit all non-optional data required on the online entry form to be eligible. Incomplete entries are void. Entrants who access the Website may be given the option to receive commercial emails and brochures from Sponsor, FDAF, and their affiliates, but eligibility to participate in the Promotion is not dependent upon Entrant’s consent to receive such emails or brochures. All requested Information must be provided to participate in the Promotion and to be eligible to win a prize. Unintelligible entries; entries with incomplete, invalid, incorrect or noncurrent information; entries that are counterfeit, damaged or tampered with in any way; and entries with printing, production or typographical errors will be disqualified. Disqualified entries and entries that are late, lost, damaged, misdirected, stolen or not delivered are not the responsibility of Sponsor and will be disqualified. Sponsor is not responsible if a potential winner does not receive his or her prize because erroneous, expired, canceled, fraudulent or fake information was provided during Promotion. Proof of sent entry and/or entry receipt (a copy of a "thank you" screen or message) does not constitute proof of actual receipt of entry by Sponsor for purposes of this Promotion.

 

Participation must be by Entrant. Participation by any other individual or entity, and/or originating at any other website, email address or phone number, including, but not limited to, commercial promotion, subscription notification and/or promotion entering service sites, is invalid and will be disqualified from this Promotion. Any attempt by any Entrant to obtain more than the stated number of entries by using multiple email addresses, phone numbers, identities, registrations or logins; entries through a sweepstakes club or similar entity; or any other unauthorized method of entry will void all of Entrant's entries and Entrant will be disqualified from the entire Promotion. Submitting mass entries or entries generated by an automated program, script or macro, or the use of any other similar device, program or method to enter this Promotion is prohibited and will result in disqualification.

 

In the event of a dispute as to the identity of Entrant, the authorized account holder of the email address used to enter will be deemed to be an Entrant. A potential winner may be required to show proof of being the authorized account holder. The "authorized account holder" of an email address is the natural person assigned to that email address by a service provider or any other organization (business, educational institution, etc.) responsible for assigning accounts to that email address. If the identity of the individual who actually participated in the Promotion cannot be resolved to Sponsor's satisfaction, the affected individual's entry will be deemed ineligible.

 

Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be in violation of these Official Rules, tampering with the entry process or the operation of the Promotion (including, but not limited to, tampering with websites, email addresses or phone numbers), or acting in an unsportsmanlike or disruptive manner. Any attempt to undermine the operation of the Promotion may be a violation of criminal and civil law, and Sponsor reserves the right to seek damages to the fullest extent permitted by law from any person it finds to have made such an attempt.

 

6. Winner Determination:  On or around March 24, 2026, the Sponsor will randomly select three (3) potential first prize winners from among all eligible entries received during the Promotion Period.

 

At the game event as outlined below in Section 7, the three (3) first prize winners will be asked to participate in the grand prize event (“Grand Prize Event’). During the Grand Prize Event, each of the first prize winners will meet before the start of the game near the designated area. Each of the three (3) first prize winners will select a key from a provided bowl and try to unlock the vehicle grand prize (as outlined below in Section 7 B) with the key he/she selected. The one (1) first prize winner whose key unlocks the vehicle will be deemed the potential grand prize winner. 

 

If the Grand Prize Event (as outlined below in Section 7A) is canceled for any reason, the Sponsor will randomly select one (1) potential grand prize winner in a random drawing from among the eligible first prize winners on a date to be determined by Sponsor in its sole discretion. 

 

Each winner is considered a potential winner pending verification of his/her eligibility and compliance with these Official Rules. All potential winners are subject to eligibility verification, on an ongoing basis, by Sponsor, whose decisions are final and binding. An Entrant is not a winner of any prize, even if notified of being a winner and/or issued any item of value, unless and until Entrant's eligibility has been, and continues to be verified to the satisfaction of Sponsor.

 

7. Prizes:

 

A.  First Prizes (3): Each first prize gives a winner and three (3) guests four (4) tickets to the regular season Athens Rock Lobsters game in Athens, GA on April 3, 2026 (each a “First Prize”). The First Prize also includes two (2) hotel accommodations (single room/double occupancy) for one (1) night, two (2) customized numbered 26 Athens Rock Lobsters Jerseys (name plate customization only), $1,000 cash, and two (2) season tickets for the regular season for winner and guest. Each First Prize winner will also have the opportunity to participate in the Grand Prize Event to determine the grand prize winner. There will be no more than three (3) First Prizes in the Promotion. The approximate retail value (“ARV”) of each First Prize is $3,316.

 

Each winner’s guest must be eighteen (18) years of age or older. If the winner elects to travel or partake in the First Prize without a guest, no additional compensation will be awarded to the winner. Trip must be taken April 3, 2026 and return on April 4, 2026 or prize will be forfeited. If a winner is unavailable to travel on the dates specified above, the First Prize will be forfeited altogether and an alternate winner will be selected. The actual value of the trip may vary. Any difference between the estimated ARV and the actual value of the Grand Prize will not be awarded. Each winner and guest are responsible for having valid travel documents including government identification and/or passports. Each winner is responsible for all travel expenses not included herein, including gratuities, meals, and any other incidental costs or expenses related to participation in this First Prize. Guest of each winner must sign and return a travel liability release before travel will be booked. Each winner and his or her guest hereby acknowledges that Sponsor has not and will not obtain or provide travel insurance or any other form of insurance for any part of the trip. Each winner will be required to provide a major credit card upon hotel check-in, and all in-room charges will be charged to the credit card. Any damage to the room will be the responsibility of each winner. Sponsor bears no responsibility if any event, element or detail of the First Prize is canceled, postponed or becomes unavailable for any reason.

 

Sponsor is not responsible if First Prize event is delayed, postponed, or canceled for any reason. If the First Prize event or component thereof is rescheduled or postponed, the dates of the trip will change and the portion of the First Prize associated with that event or component thereof will be awarded for the rescheduled date. The trip will take place so that each winner may attend the Grand Prize Event. If a winner is unavailable at such time for any reason, the Grand Prize Event and trip will be forfeited altogether. If the Grand Prize Event or component thereof is canceled or otherwise does not occur for any reason whatsoever, the First Prize winners will receive the cash equivalent of the First Prize.

 

Winners agree that First Prize game admission is awarded pursuant to a revocable, nontransferable license that is personal to that applicable winner, and may not be sold, resold, auctioned, bartered, assigned, exchanged, placed in commerce, transferred, given away, donated or otherwise conveyed. Sponsor, employees and representatives of the Athens Rock Lobsters, and employees and representatives of the Akins Ford Arena reserve the right to remove or to deny entry to winner and/or his/her guest if either winner or his/her guest(s) violates the previous restrictions or engages in a disruptive manner, or with intent to abuse, threaten or harass any other person at the event.

For FHPL Tickets: Use of any Federal Prospects Hockey League game/event/exhibition ticket is subject to the standard terms, conditions, and health and safety policies applicable to the ticket. Seat locations at the game/event/exhibition and, unless otherwise stated in the applicable prize description, exact game/event/exhibition date shall be determined in the sole discretion of Sponsor. Federal Prospects Hockey League game/event/exhibition dates and times are determined in the sole discretion of the Office of the Commissioner and/or the applicable team and may be subject to change. The terms and conditions of the tickets awarded as part of any prize will govern in the event a legal game/event/exhibition, as defined by Federal Prospects Hockey League, is not played or held due to weather conditions, an act of God, an act of terrorism, civil disturbance, or any other reason. Each winner and his/her guest(s) agree to comply with all applicable arenas and venue regulations in connection with the prize; see https://www.classiccenter.com/akins-ford-arena/fan-guidelines for details. Sponsor and the FPHL Entities reserve the right to remove or to deny entry to any winner and/or their guest(s) who engage in a non-sportsmanlike or disruptive manner or with intent to annoy, abuse, threaten, or harass any other person at the game/event. Sponsor and the FPHL Entities will not be responsible for weather conditions; acts of God; acts of terrorism; civil disturbances; local, state, or federal regulation, order, or policy; work stoppage; epidemic, pandemic, or any other issue concerning public health or safety; or any other event outside of their control that may cause the cancellation or postponement of any Federal Prospects Hockey League game/event/exhibition. Federal Prospects Hockey League game/event/exhibition tickets awarded as prizes may not be resold, offered for resale, or used for any commercial or promotional purpose whatsoever. Any such resale or commercial or promotional use may result in disqualification and prize forfeiture, and may invalidate the license granted by the game/event/exhibition ticket.

 

B.  Grand Prize (1): There is one (1) grand prize available to be won as a random drawing during the Athens Rock Lobsters game in Athens, GA on April 3, 2026.

●     Grand prize includes one (1) 2025 Ford Bronco. Approximate Retail Value (“ARV”) of the first Grand Prize is M.S.R.P $59,417.00 USD.

Any difference between the ARV and actual Grand Prize value will not be awarded. The Grand Prize winner, or an individual specifically authorized in writing by the Grand Prize winner who is not otherwise ineligible, must be available to receive and take ownership of SUV on Friday, April 3, 2026. The SUV will be available for pick up from Akins Ford dealership in Winder, GA at a date and time chosen by the Sponsor at its sole discretion. Transportation to the dealership is the sole responsibility of the Grand Prize winner. The Grand Prize winner will be solely responsible for all federal, state, and local income taxes based on the value of the SUV as well as any applicable registration, license, title and insurance fees, and any expenses not listed herein related to receipt, possession, acceptance, and use of the SUV. The SUV may be used as a display vehicle for events regarding the Promotion. The actual style, color, design and features of the SUV may vary from any depictions of it in the promotion materials. Sponsor is not responsible for the postponement or cancelation of the award ceremony due to circumstances beyond its reasonable control. Normal wear and tear of driving, including mileage as a display vehicle, may exist. The Grand Prize winner must show a valid driver's license and proof of insurance before the SUV will be awarded.

 

C.  For All Prizes: No prize may be transferred or assigned in whole or in part. No cash or other substitution may be made, except by Sponsor, who reserves the right to substitute a prize in whole or in part with another prize of comparable or greater value if the intended prize is not available for any reason as determined by the Sponsor in its sole and absolute discretion. The winners will be responsible for all expenses (except those specified as being the Sponsor's responsibility under these Official Rules) relating to acceptance and use of the SUV and for all applicable taxes (including but not limited to federal, state, local, or income).

 

Actual value of the prizes may vary. All additional costs, including, but not limited to security fees, gratuities, tips, taxes, and other personal charges not specifically described as part of the prizes above are not included in the respective prize. No compensation or substitution will be provided for any difference in prize value. Sponsor is in no way responsible for any cancellations, delays, postponements, diversions, substitutions, or any other act, omission, or result thereof, caused by any third party. The prizes must be accepted as awarded without substitution and are not, in whole or in part, assignable, transferable or available for resale. Prizes have no cash surrender value, except where required by law. Sponsor has made no warranty, representation or guarantee, express or implied, in fact or in law, with respect to any prize. This includes, without limitation, any warranty, representation or guarantee related to the prizes quality or fitness for a particular purpose. Prizes are subject to availability and Sponsor reserves the exclusive right to substitute a prize (or a component thereof) with another prize (or component thereof) of equal or greater value if the respective prize is not available for any reason, as determined in Sponsor's sole discretion. Federal, state, and local taxes and all other costs and expenses associated with acceptance and use of any prize not specified herein as being awarded are the winner's sole responsibility. Prizes specific terms and conditions apply.

 

Any prize details not specified above will be determined by Sponsor in its sole discretion. If a winner is disqualified, not eligible or for any other reason cannot accept a First Prize as stated, then Sponsor may randomly select a new First Prize winner from the pool of eligible entries. Where legal, each winner will be required to submit, without alteration and in the form provided by Sponsor, a completed and signed Affidavit of Eligibility and Liability & Publicity Release (the "Release"), along with a properly completed U.S. Department of the Treasury Internal Revenue Service Form W-9, within the required time period to be eligible to receive the Prize (if applicable; required time period will be communicated in the Release).

 

No more than three (3) First Prizes and one (1) Grand Prize as set forth in these Official Rules will be awarded. In the event that technical or any other reasons cause more than the stated number of prizes as set forth in these Official Rules to be available and/or claimed, Sponsor reserves the right to award only the stated number of prizes by a random drawing from among all legitimate, unawarded, eligible prize claims.

 

D.  Odds of Winning: Odds of winning a First Prize depend on the number of eligible entries received during the Promotion Period. The odds of winning the Grand Prize is 1:3.

E. Total ARV of All Prizes: The total ARV of all prizes in the Promotion is $69,365.00 USD.

 

 

8. Winner Verification: To be verified as eligible to receive a prize, each potential winner must fulfill all requirements and continue to comply with all terms and conditions of these Official Rules, and not be disqualified for any reason. The potential First Prize winners will be notified by email (subject to Sponsor's discretion) and the Grand Prize winner will be notified at the Grand Prize Event. If a potential winner of the First Prize cannot be contacted using the information provided or fails to respond to Sponsor's attempt to notify them of selection within 24 hours; if any First Prize or notification is returned as undeliverable or yields an error or undeliverable type "bounce back" email (regardless if the message is ultimately delivered to the recipient); if a potential winner fails to sign and return the Release or any other required documentation within the allotted time-frame or fails to comply with these Official Rules; if any potential winner is unable or unwilling to accept a prize as stated; or if the potential winner cannot be verified as eligible for any other reason at any time before, during or after the Promotion Period, the potential winner is disqualified and forfeits the respective prize and an alternate will be selected.

 

Failure to provide all required information may result in forfeiture of a winner’s right to claim a prize and may result in the respective prize being awarded to an alternate winner if time permits. If a potential winner is disqualified, found to be ineligible or not in compliance with these Official Rules, declines to accept a prize, the prize may be forfeited. If a First Prize is forfeited, the respective First Prize may be awarded to an alternate winner, selected in random drawing from among the remaining eligible entries, as determined by Sponsor in its sole discretion. If the Grand Prize is forfeited, the Grand Prize may be awarded to an alternate winner by a random drawing from among the remaining First Prize winners. If, after good faith attempt, Sponsor is unable to award or deliver a prize, the prize may not be re-awarded. IF A PRIZE REMAINS UNAWARDED FOR ANY REASON AFTER REASONABLE ATTEMPTS OF SELECTING A POTENTIAL WINNER OR BECAUSE THERE IS INSUFFICIENT REMAINING TIME TO AWARD A PRIZE, THE RESPECTIVE PRIZE WILL NOT BE AWARDED IN THIS PROMOTION.

 

Upon verification of eligibility, the First Prize winners will be contacted to make arrangements for the First Prize fulfillment. Upon verification, the Grand Prize winner will be required to pick up the vehicle from Akins Ford dealership in Winder, GA at a date and time chosen by the Sponsor at its sole discretion.

 

If winners are awarded and claim the prizes, a winner list may be obtained by printing the requestor's name, address, city, state or province/territory and zip or postal code on a 3x5" postcard and mailing it to Music Audience Exchange, Inc., Attn: 2025 Akins Ford Athens Rock Lobsters - FordEvents.Live Sweepstakes Winner List, 2595 N. Dallas Pkwy. #440, Frisco, TX 75034. Limit one (1) request per person. Winner list requests must be received no later than June 1, 2026.

 

Sponsor reserves the right to cancel, suspend, or modify the Promotion, or any part of it, if any fraud, technical failures, or any other factor beyond Sponsor's reasonable control that impairs the integrity or proper functioning of the Promotion, as determined by Sponsor in its sole and absolute discretion. Sponsor reserves the right, in its sole and absolute discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Promotion, to be acting in violation of these Rules or any other promotion, or behaving in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Promotion may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor's failure to enforce any term of these Rules shall not constitute a waiver of that provision. The invalidity or unenforceability of any provision of these Rules will not affect the validity or enforceability of any other provision. In the event any provision is found invalid or unenforceable, these Rules will otherwise remain in effect in accordance with their terms as if the invalid or unenforceable provision was never included. All personal pronouns and defined terms used in these Rules, whether used in the masculine, feminine or neutral gender, shall include all other genders, the singular shall include the plural, and vice versa.

 

The location where the SUV will be presented is managed and controlled by third parties, and Sponsor does not have any power to manage or control such location’s operations, including control over entry policies and restrictions for the SUV presentation. Sponsor makes no guarantees or warranties about the prize presentation itself or a prize winner’s ability to receive the SUV at such presentation, including access to the venue. The Sponsor is not responsible or liable for any loss or penalties incurred if the SUV presentation must be delayed, postponed, canceled or changed for any reason, for acts of nature or for amenities, services, or facilities not being available (or entry restricted or limited) due to renovations, strikes, bankruptcy, or acts of nature. In the event of an inconsistency between these Rules and any disclosure or other statement contained in any Promotion-related materials, including, but not limited to, an entry form or any point-of-sale, radio, television, print, or online advertising, these Rules shall prevail and govern.

 

 

9. Limitations of Liability: By entering or participating in this Promotion in any way, each winner agrees to release, discharge, indemnify and hold harmless Sponsor, FDAF, Ford, Ford Credit as well as any other automotive original equipment manufacturer or Supplier, GTB as well as any other marketing/communications agency or media companies assisting with implementation and execution of the Promotion, the Athens Rock Lobsters, CCA, the FHPL Entities, and their respective parent companies, subsidiaries, sponsor marketing employees, and affiliates, and companies involved in the implementation and execution of the Promotion[2] [MK3] , Content Hosts, and each of their respective subsidiaries, affiliates, vendors, advertising or promotional agencies and distributors, and each of their respective parent companies and each such company's officers, directors, employees and agents, as well as the immediate family (spouse, parents, siblings and children) and household members of each such individual (collectively, the "Released Parties") from and against any loss, damage, injury, claim, or cause of action related in any way whatsoever to this Promotion, these Official Rules, or the rights, consents and licenses granted to Sponsor under these Official Rules, including, but not limited to, infringement of any right of publicity or intellectual property; threatened or actual injury, loss or damage to any person, including death and disability; defamation or portrayal in a false light (intentional and unintentional); invasion of privacy; and damage to or loss of property, arising out of such Entrant's participation in the Promotion or receipt or use, non-use or misuse of any prize. In no event will Released Parties be responsible or liable for any damages or losses of any kind, including indirect, incidental, consequential or punitive damages arising out of this Promotion. Entrants waive any right to claim ambiguity in these Official Rules. License[s] from entrant: To the extent allowed by law, participation in the Promotion in any way and/or acceptance of, or participation in, any prize constitutes each Entrant's irrevocable consent for, and grant of a non-exclusive, sub-licensable and assignable license to Sponsor to use, publish, post, or display Entrant’s name, likeness, photograph, voice, opinions, statements, prize information, biographical information, and/or hometown and state, province, or territory, regardless of whether altered, modified, distorted, edited, or used alone or with other material, in Sponsor’s sole discretion, for promotional, advertising, trade, and publicity purposes in any medium now known or later discovered, worldwide and in perpetuity, without review or approval by Entrant, and without further notice, payment, or consideration of any kind to Entrant. Void where prohibited by law.

 

All rights, consents and licenses granted to Sponsor under these Official Rules will survive the termination of this Promotion. Entrant's consent and license may only be revoked in writing, and the mere ending of this Promotion or Promotion Period is not sufficient to revoke such consent or license.

 

11. Right to Modify or Cancel: The invalidity or unenforceability of any provision of these Official Rules will not affect the validity or enforceability of any other provision. Sponsor reserves the right to cancel, suspend and/or modify the Promotion, or any part of it, if any mistake, clerical or typographical error, omission, fraud, technical failure, tampering, computer virus or other factors, technical or otherwise, beyond Sponsor's reasonable control, impairs Sponsor's ability to properly conduct the Promotion, as determined by Sponsor in its sole discretion, subject to any applicable law or regulation. In such an event, Sponsor reserves the right, but not the obligation, to award any applicable prize(s) by random drawing from among the eligible entries received up to the time of the cancellation, suspension, or modification of the Promotion. Inclusion in such random drawing is Entrant's exclusive remedy under such circumstances.
